1. Introduction

Welcome to Accountable. These Terms of Service ("Terms") govern your use of the Accountable mobile application, website (stopdrinkingapp.com), and services (collectively, the "Services") operated by Accountable App ("we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these terms, you do not have permission to access the Services.

2. Account Registration

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Services.

You are responsible for safeguarding the password you use to access the Services and for any activities or actions under your password. You agree not to disclose your password to any third party.

3. User Content and Community Guidelines

Our Services allow you to post, link, store, share and otherwise make available certain information, text, graphics, or other material ("User Content"). By providing User Content to the Services, you grant us the right to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the Services.

You agree that this license includes the right for us to make your User Content available to other users of the Services, who may also use your User Content subject to these Terms.

Content Restrictions

You are solely responsible for the User Content that you post, upload, or otherwise make available via the Services. You agree that you will not post User Content that:

• Contains unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content
• Promotes illegal activities or conduct that is abusive, threatening, obscene, or defamatory
• Infringes upon or violates any third party's rights, including intellectual property rights
• Contains software viruses or any other malicious code
• Constitutes unauthorized or unsolicited advertising, junk or bulk email ("spamming")
• Impersonates any person or entity, or falsely states or otherwise misrepresents your affiliation with a person or entity
• Contains personal information or confidential information about others without their permission

Community Guidelines

When participating in community forums or other social features of our Services, you agree to:

• Treat other users with respect and kindness
• Post content that is relevant to discussions about sobriety, alcohol reduction, and wellness
• Be supportive of others in their journey to reduce or eliminate alcohol consumption
• Respect the privacy and personal boundaries of other users
• Consider the sensitivity of topics discussed and use appropriate content warnings when necessary

Content Moderation

We reserve the right, but have no obligation, to monitor or review User Content. We may edit, remove, or refuse to post any User Content for any or no reason at our absolute discretion. If we believe your User Content violates these Terms or our Community Guidelines, we may remove the content and/or terminate your account without prior notice.

4. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, protect, and disclose information and data when you use our Services. By using our Services, you agree to the collection and use of information in accordance with this policy.

5. Subscription and Billing

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring basis, depending on the type of subscription plan you select.

Subscription Management

Subscriptions are managed through your Apple App Store or Google Play Store account, facilitated by RevenueCat, our subscription management provider. Payment will be charged to your App Store or Google Play account at confirmation of purchase.

Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play Store after purchase.

Free Trials

We may offer free trials to new users. If you sign up for a free trial, you will not be charged during the trial period. However, if you do not cancel before the trial period ends, you will automatically be charged for a subscription at the then-current rate.

Price Changes

We reserve the right to change subscription fees at any time with reasonable notice. Such notice may be provided at any time by posting the changes to our website or via the Services itself. Price changes will not affect subscriptions that have already been paid for until the next renewal date.

Refunds

Refund requests are handled by Apple App Store or Google Play Store according to their respective policies. We do not process refunds directly and have no control over their approval or rejection.

6. Termination and Account Deletion

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Services will immediately cease.

Account Deactivation and Deletion

You can manage your account directly through the app:

• Use the Account Deletion feature in the Settings tab to permanently delete your account and all associated data
• Contact us at [email protected] if you prefer email assistance or cannot access the app

Upon account deletion request (whether through the app or email), we will delete your personal information from our active databases within 48 hours, though some information may remain in our backups for a limited period as specified in our Privacy Policy.

Content Persistence

Please note that any User Content you have shared through our social features (including forum posts and public messages) may remain visible even after your account is deleted. Your username will be changed to "Deleted User" but the content itself may persist if it has been viewed or engaged with by other users.

Subscription Cancellation

Terminating your account does not automatically cancel your subscription. You must separately cancel your subscription through your App Store or Google Play Store account settings to avoid future billing.

7. Limitation of Liability

In no event shall Accountable App, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

8. Disclaimers

General Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Medical Disclaimer

Accountable App is designed as a supportive tool for monitoring and reducing alcohol consumption, not as a medical treatment or healthcare service. The app:

• Does not warrant that it will help you reduce or stop drinking alcohol
• Is not a substitute for professional medical advice, diagnosis, or treatment
• Should not be used to self-diagnose or treat alcohol use disorder or any other health condition
• Should not be used in lieu of consulting with qualified healthcare providers

Individual results may vary, and the app is designed as a tool to assist in monitoring consumption patterns only.

Alcohol Withdrawal Warning

Suddenly stopping alcohol consumption can be dangerous for individuals with physical dependence. If you experience withdrawal symptoms (such as tremors, sweating, anxiety, insomnia, nausea, or seizures), seek medical assistance immediately. Always consult a healthcare provider before significantly changing your alcohol consumption patterns.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

10. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Accountable App and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Accountable App or its affiliates. You must not use such marks without our prior written permission.

11. Third-Party Services

Our Services may contain links to third-party websites, services, or resources that are not owned or controlled by Accountable App. We have no control over, and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

We use third-party services including:

• Supabase - for secure database and authentication services
• RevenueCat - for managing in-app subscriptions
• Sentry - for error tracking, performance monitoring and user feedback
• PostHog - for product analytics and user behavior tracking
• Apple App Store and Google Play Store - for app distribution and payment processing

Your interactions with such third-party services are governed by their respective terms of service and privacy policies.
